We regularly feature a new ‘case of note’ on our site, exploring significant legal cases impacting the NHS. Our latest case examines allegations of clinical negligence in a trust’s failure to identify Cauda Equina Syndrome (CES), the court considered divisive claims, with experts disagreeing on the MRI interpretation and whether CES was present. A big congratulations to Sangita Talati Bodalia, our Head of Early Notification (Legal) who won the Civil Lawyer Award at the Asian Legal Awards 2024 on Saturday! With 15+ years of legal expertise, Sangita has been nominated particularly for her close collaboration with NHS Trusts, panel lawyers and with stakeholders such as Action against Medical Accidents, Baby Lifeline and Association of Personal Injury Lawyers (APIL). Speaking about her win Sangita said, “I am deeply humbled and honoured to have been named Civil Lawyer of the Year at the Asian Legal Awards 2024. Sharing this recognition with such talented individuals in our profession was truly inspiring. This award is a testament to the incredible work of my team at NHS Resolution, whose dedication to innovation, early resolution, and patient-centred care drives meaningful change. I couldn’t have achieved this without their support, nor without the guidance of mentors and my family, who have always stood by me. “A heartfelt congratulations to all the winners and nominees for their remarkable achievements—it was a privilege to celebrate with you. “Here’s to breaking barriers and making a continued impact in all that we do.” Megan Bidder, Director of Safety and Learning, commented, "I am thrilled to congratulate Sangita Talati Bodalia on her well-deserved win of the Civil Lawyer Award at the Asian Legal Awards 2024. "This award recognises her longstanding commitment and leadership of our Early Notification Legal team, and her transformative work in improving outcomes for families affected by serious birth injuries.” SOCIETY OF ASIAN LAWYERS LIMITED #ALA2024

It was a pleasure today to speak at the EIDO conference on consent and the importance of understanding why it is such a vital process to get right. It was good to hear the clinicians perspective on this topic. Over the last five years NHS Resolution has paid out significant amounts on cases where consent was an issue. Supported decision making (consent) is a vital part of patient care. Consent claims often centre on the quality and nature of information provided to patients to make informed decisions about their healthcare. NHS Resolution has some great resources on their website to assist in understanding this topic in more detail.
