Is the Office for Students the "right organisation to help universities by setting out a basic framework for how they should conduct sexual misconduct and harassment disciplinary investigations and proceedings. Ideally, this would be a step-by-step guide on how to run fair proceedings into alleged sexual misconduct."? In these cases what is being investigated? Rape or Sexual Misconduct? Do you know what the difference is and the impact on investigation? Is there a difference even? Do YOU think you are capable of objectively investigating such incidents? Are YOU trained, qualified, and experienced to investigate? Should lawyers have a right of audience in such civil investigations? Do the rules of CPIA apply to such investigations? ....... The OfS define sexual misconduct as “any unwanted or attempted unwanted conduct of a sexual nature. This includes, but is not limited to sexual harassment, sexual assault, and rape”. This presents quite a unique challenge, investigating misconduct that might breach policy and codes to the civil standard, balance of probabilities, that in any other context might be investigated as serious criminal offences to the higher standard, beyond reasonable doubt. NEVER has it been more important to outsource specialist workplace investigation to qualified experts who can deliver reliable outcomes. "It's even more important for employers to be proactive and systematic in how they prevent and tackle sexual harassment at work; this is not a 'tick-box' exercise,” Ben Willmott, head of public policy at CIPD, stressed. Employers will now need to demonstrate tangible steps taken to prevent harassment, especially since tribunals now hold the power to increase compensation by up to 25 per cent if they find an employer has breached this duty. Willmott advised businesses to focus on creating a “culture of dignity, respect, and inclusion”, which includes “values-based leadership, effective training for line managers, and robust reporting procedures”. And once reported who is going to investigate? How are they going to investigate? What qualifies them to investigate? Do phrases such as "accused", "complainant" have a place in a civil workplace investigation? How important is balancing organisational and individual reputation with a non-judgemental and open-minded investigation? Is an "experienced HR professional" the same as an "external investigator"? Can you guarantee anonymity of the complainant (reporting party)? How (and where) will you document decisions and the rationale behind them so that you can explain to the tribunal in 3 years time? Should "complainants" be automatically believed? Is a false complaint the same as vexatious? Why aren't investigators qualified to (at least) OFQUAL Level 3 investigation AND investigative interviewing (meetings)?
