As we wrap 2024, commercial property specialist, Melanie Greer-Walker, summarises the key developments in property law: ''Commercial landlords and tenants will be glad to hear there is a current Law Commission consultation to the contracting out of security of tenure process under the Landlord and Tenant Act 1954. It remains to be seen what the results will be these are, but I think practitioners are hoping that the process will be streamlined, and the Law Commission have said they do intend to modernise this 70 year old piece of legislation. Of interest to residential landlords and tenants is the Renters (Reform) Bill. The law is expected to pass in Spring 2025, so clients need to keep a close eye on progress. It is expected that s21 (no fault) eviction will be removed, including retrospectively for existing tenancies, so anyone granting new assured shorthold tenancies (ASTs) in the coming months needs to factor this in, or actively look to obtain vacant possession prior to the passing of the Bill into law if desired. There have also been changes to SDLT. Unfortunately, this is bad news for residential purchasers with increases for second home owners, company purchasers and buy to let properties from 31 October 2024. The nil rate thresholds and first-time buyers relief are also reducing from 1 April 2025.'' In addition, 2024 was the year that Biodiversity Net Gain came into force and we have been helping many organisations to readjust their strategies to improve the state of nature. That is why we have been honoured to work alongside Habitat for Humanity Great Britain and their campaign to turn empty commercial spaces into high quality housing.
