On Tuesday, December 10th, the ITU Webinar ‘CFC Reporting 2024: Legislative Changes, Deadlines, and Practical Advice for Businesses’ was held, organised by the IT Ukraine Association in collaboration with #ITUPartner Juscutum Legal Engineering. The speaker of the webinar was Mykola Klymenko, Head of Accounting Support Practice at Juscutum. Among the key points discussed: 🖋️ A CFC is a legal entity registered abroad, which is under the control of a physical or legal person who is a resident of Ukraine; 🖋️ The controlling person is a physical or legal person who is a resident of Ukraine. Their duties towards the state include submitting notifications about changes in the CFC, reporting, and providing information upon additional requests; 🖋️ Reasons for submitting a CFC notification include acquiring or indirectly acquiring a share in the CFC, its liquidation, the commencement of actual control, transferring a share in a foreign legal entity, and changing the share in the capital structure of the controlling person; 🖋️ Adjusted profit refers to the portion of the profit proportional to the share of the controlling person; 🖋️ Forms of CFC reporting include shortened and full reports; 🖋️ Penalties for late or incomplete submission of CFC reports: for non-submission, late submission or failure to notify about changes in the CFC. It’s important to check the accuracy of adjusted profit calculations and use the latest NBU exchange rates for conversion into Ukrainian hryvnias. Gather all necessary documents and submit reports and notifications about changes in the CFC on time. If necessary, consult auditors or specialists to verify your reports.
