It’s one thing to talk about AI and its many facets both legal and technical. It’s another thing altogether to actually engage and negotiate with vendors on legal contracts for the deployment of AI in your firm, to implement AI usage policies and monitor responsible use of AI, to draft notifications for your clients to their customers on the use of customer data in AI systems, to draft and provide external facing AI use statements, to create implementable AI use cases so that our lawyers and staff actually know how to use these very expensive platforms in their workflow. It not so easy to then at a macro level to advocate for nationwide AI security standards and profession wide AI usage guidelines. Tag on articulating pithy and robust arguments pushing for a fundamental change in legal services pricing by moving away from the hourly fee model and collectively there you see just one slice of the daily routine of my Rajah & Tann AI core team, Rajah & Tann Asia TMT lawyers, Rajah & Tann Technologies tech experts and I in driving for meaningful AI adoption at Rajah & Tann Asia and the broader legal profession. Failing to comply with the Singapore consumer protection’s court order costed a nail salon chain SGD30 thousands and its managing director to go behind the bars - A regional lesson Err in practice Due to multiple consumer complaints of misleading information on their treatment packages, non-transparent pricing offer and billing, the court back in 2022 ordered Nail Palace to publish their err in business practice in four major national newspapers. On top of such, for two years they must provide a declaration to their consumers on this ill-practice and obtain the consumer’s consent before proceeding with the services. The publication must be made before 18 August 2023, and the declaration & consent was supposed to be in place effective after the 2022 court decision. However, the publication was only made 13 days after the deadline and was presented in an unreadable manner hence did not fit for publicity. Meanwhile, the declaration & consent has never been implemented. Given such, two of its branches were fined for SGD15 thousands each, and the managing director faces a four month imprisonment. Impact for business The publication of its unfair trading practices harming the consumer is a huge slap to business. However, the requirement to declare it and obtain a consent from each of their consumers before performing their services for a full two year period is the real nightmare for the impacted business in the mid and long terms. The reason is apparent, such a declaration & consent may factor in the consumers’ bad perception and trigger distrust to the business, even before they decide to obtain any services. If business fails to outgrow this by continuously improving and communicating their services, exiting the market altogether may become a reality. Key takeaways for regional market As the first competition commission in the region that also championed consumer protection, this case may set precedent to the remaining jurisdictions across SEA. This opens the possibility for other consumer protection commissions/ agencies in the SEA to pursue similar orders to businesses in their effort to protect consumers. Given the gravity it poses in the mid and long run, the immediate mitigating step to consider is that businesses may want to review whether their current marketing and sales programs are in compliance with the local regulations, are free from deceptive or non-transparent promotion programs and offers. Concurrently, businesses could give thought to extend the refreshers on fair trading compliance to beyond their legal department, i.e. so as to include their marketing and sales teams. Or to put it in another way, it is about time that the effort to create a compliance culture to be seen weighed as a crucial business investment instead of a mere annual KPI-event. Legitimate interest, as defined in the Circular, pertains to the actual and real interest, benefit, or gain that a PIC or third party may derive from processing specific personal information. However, this basis cannot be applied to sensitive or privileged information under Philippine privacy laws. The Circular outlines a three-step assessment process: the Purpose Test, Necessity Test, and Balancing Test, ensuring that the legitimate interest does not override the fundamental rights and freedoms of data subjects. Controllers are required to document their legitimate interest assessments and maintain records, with a transitory compliance period, for aligning document management systems with the Circular's requirements. Non-compliance with the Circular may result in potential criminal, civil, and administrative liabilities. “PETs stand at the forefront of our digital future.” Clarisse Girot kickstarts the Singapore-OECD Expert Workshop on Privacy Enhancing Technologies. There are lots of announcements and initiatives on PETs and for good reason given the emergence, proliferation, and potential of PETs. Session one is underway, mapping PETs to specific use cases, such as age assurance, health data governance, open banking, computer vision, and research. 🔗 Just yesterday the Personal Data Protection Commission (PDPC) released a proposed guide to help organisations understand synthetic data generation techniques and the application of those techniques in potential use cases, particularly for AI governance.
