  • 💡 Hive-Downs and Their Impact on Secured Lending 💡 Hive-downs are gaining traction as a restructuring strategy for businesses looking to streamline operations, attract investors, or prepare for asset sales. But what is a hive-down and what implication does a hive-down have for secured creditors under Swedish law? Hive-downs offer benefits such as improved financing opportunities and operational efficiency but also present challenges, including structural subordination risks, claw-back disputes, and ensuring compliance with creditor equality principles. Understanding how a corporate restructuring initiated by debtors affect creditors’ rights is more important than ever. At REFI STHLM, we’re addressing these complexities and exploring ways to safeguard creditor interests while finding ways to leverage the potential of hive-downs. • 📌 Chapter 11 DIP Financing: Key Considerations for Swedish Lenders 📌 The increasing number of Swedish companies filing for Chapter 11 in the US brings new challenges for Swedish creditors. While US court orders aren't directly enforceable in Sweden, compliance with these orders—such as those emerging from Chapter 11 proceedings—might still be critical for maintaining access to USD clearing. This raises important questions about the implications of the US bankruptcy process for Swedish lenders.   In our latest article, we dive into a number these implications with a focus on Debtor-in-Possession (DIP) financing. This financing method can offer lifelines to struggling debtors, enabling continued operations even when they don’t meet the criteria for Swedish business reorganisations. However, DIP financing can also significantly alter claim priorities, potentially putting Swedish secured creditors at a disadvantage.   Learn more about the risks of DIP financing and why it’s essential for Swedish creditors to stay informed.   Full article here 👉 https://lnkd.in/dPyeibtz

  • Global challenges, U.S. solutions — or local challenges, U.S. problems? Why Chapter 11 restructurings may reshape creditor dynamics beyond U.S. borders. As Swedish and European companies like Scandinavian Airlines (SAS) increasingly turn to Chapter 11 bankruptcy in the U.S., the ripple effects for creditors—especially non-U.S. banks—are profound. Our latest article explores how reliance on USD clearing systems pressures Swedish and other non-U.S. lenders to align with U.S. court rulings, even when those rulings aren't legally enforceable locally. At RE:FI STHLM, we’re closely monitoring this trend, which is redefining creditor-debtor relationships and setting new precedents in global finance. 📖 Read the full article here: https://lnkd.in/d3PfTtuR #BankingAndFinance #Restructuring #Chapter11 #GlobalFinance
