ARE TRANSACTIONS CONTRARY TO DECREES ALSO NULL AND VOID DUE TO VIOLATION OF LEGAL PROHIBITIONS? In this case, Business Household "Trà sữa và Bánh R" was granted a Business Registration Certificate on November 23, 2018. The plaintiff and the defendant entered into a commercial franchise agreement. The High Court in Da Nang held: According to Article 8 of Decree 08/2018/NĐ-CP, a trader is permitted to grant a commercial franchise if the business system intended for franchising has been in operation for at least 01 year. However, at the time of the commercial franchise agreement, the franchisor's business system had been in operation for less than 01 year. Therefore, the franchisor did not meet the conditions for franchising. As a result, the commercial franchise agreement was null and void due to violation of a prohibition. A ‘Legal Issues Seminar- General IP’ (LIS-GIP) was conducted by Uroosa Shahzad, Associate, on “Whether Cause of Action to file an IP suit arises on the basis of reservations made through third-party websites?”. The seminar discussed relevant provisions under the Code of Civil Procedure, 1908 to determine territorial jurisdiction on the basis of cause of action. The session deconstructed decisions of the relevant High Courts wherein territorial jurisdiction was determined on the basis of online availability of third-party websites that facilitate making of bookings or reservations. The seminar involved an interesting discussion on whether mere online presence of an e-commerce business virtually can be the threshold for determining jurisdiction in cases involving the use of trademarks online. The session concluded with a discussion on whether Section 20 (c) of the Code of Civil Procedure, 1908 should be given a wider interpretation in cases of trademark infringement. S.I. No. 163/2024 amends Order 84 of the Rules of the Superior Courts such that an application for leave to apply for judicial review shall be “made” when the documents grounding the application are filed in the Central Office, or in urgent cases, in the Court. This means that applications will be considered made at an earlier point in time than was previously the case. Under Law 252/2023, which pertains to the external evaluation of judges and prosecutors, the #Vetting Commission has been mandated to evaluate, in addition to other categories of subjects, candidates for positions as members of the Superior Council of Magistracy (SCM), who submitted their candidacies after 1 September 2023, as well as candidates for the SCM Boards, regardless of the date their candidacy was submitted. Their #evaluation was carried out based on Law 26/2022 concerning 𝑝𝑟𝑒-𝑣𝑒𝑡𝑡𝑖𝑛𝑔, continuing the mandate of the Pre-Vetting Commission. The Commission was tasked with evaluating 31 candidates for positions in the self-governing bodies of judges. The candidates were assessed based on the #integrity criteria established in Law 26/2022, which imposes more stringent evaluation standards compared to the criteria in the laws regarding 𝑣𝑒𝑡𝑡𝑖𝑛𝑔. In the event of failure to pass the evaluation, the sole consequence is the exclusion of the candidate from the competition.
