In a much-anticipated decision, the Supreme Court has today determined that a trustee's appointment of a company, of which the trustee was the sole director and shareholder, as a corporate trustee was not done for an improper purpose. This is in the context of a dispute between a widow and her late husband's children from a previous marriage. Once appointed, the corporate trustee removed the children as beneficiaries and distributed the trust assets to the widow.  This case is another example of the importance the courts place on the settlor's expression of the trust's purpose, as well as the powers granted to trustees. Our team has loved the opportunity to lend a hand, share their time, and make a positive impact for those in need.
