IBFD Update: Supporting Vietnam’s Global Minimum Tax Implementation Since June, we’ve been collaborating with the Vietnam General Department of Taxation (GDT) on drafting regulations to implement the Global Minimum Tax (GMT) under the OECD/Inclusive Framework Two-Pillar Solution. This effort is part of the GIZ project “Strengthening Public Financial Management in Viet Nam,” co-funded by the EU and the German Government. 📢 Public Consultations in Hanoi & Ho Chi Minh City In November and December, GDT organized public consultations to gather feedback on the draft decree for the GMT law. IBFD participated actively, presenting comments on the alignment of the draft with OECD Model Rules and addressing stakeholder queries. 🎯 Key Contributions • Presented at consultations chaired by GDT leaders, alongside stakeholders like the Big4 and international chambers of commerce. • Collaborated with GDT’s drafting team to incorporate feedback into the draft regulations. • Leveraged insights from the Knowledge Centre to review and refine the draft decree. This milestone reflects the dedication of our IBFD team. Special thanks to GDT for acknowledging IBFD’s contributions and to GIZ for their partnership. During our fruitful collaboration in the International Tax Committee of the International Law Association, Pasquale Pistone, Mariya Serafimova, and I wrote a long article on tax nexus, which examined this traditional tax issue from multiple angles. One of those angles is a realignment of tax issues with fundamental principles of (public international) law. From the comparative side, there is also a comparison with competition law's doctrine of jurisdiction there, among the other issues discussed. The article was recently published, and the IBFD World Tax Journal has selected our article to be available in open access, which is accessible to all under the link below.
