  • Starting 18 March 2024, Jersey implements Parental Bereavement Leave following a key amendment to employment law passed in October 2023. This ensures that working parents have the necessary support during one of life's most challenging times 💙Here's what you need to know: 👨👩👧👦 Entitlement: Working parents will be entitled to 2 weeks of unpaid leave from their employer following the death of a child under 18 years of age. This includes stillbirths after 24 weeks of pregnancy. ⏰ Flexible: The leave can be taken at any time up to 56 weeks from the date of the child's death, and it can be split into three separate periods of any duration. 👩👩👦 Inclusive: This will be a “day one” employment entitlement, available to mothers and fathers, as well as adoptive or surrogate parents. Additionally, partners involved in the upbringing of the child will also have access to this leave. 🔄 Transferable: Should an employee transition to a different employer, any remaining balance of Parental Bereavement Leave will be transferable. Importantly, this entitlement will not impact other forms of parental leave under the employment law.   • 🗓️ It's that time again – the leap year is upon us! Every four years, we gain an extra day in the calendar, and 2024 is the year to mark that occasion. While it might be business as usual for many, employers, this one's for you – let's talk about how leap years can impact employee pay entitlements. 💰 For those on an hourly rate, it's straightforward. If your employees work an extra day this February compared to the previous one, you'll need to compensate them for that additional time. Even if the 29th falls on a regular workday, paying them as usual is a must. More work, more pay – it's as simple as that. 👩💼 On the other hand, salaried workers drawing a fixed monthly pay won't usually see any change in their compensation if the leap year day has already been factored into their annual earnings. However, do check employment contracts for any clauses on pay during leap years – it's always best if the contract is explicit, just to be sure. ⚖️ It's crucial to keep an eye on the minimum wage to ensure compliance. Salaried staff, especially those on the statutory minimum wage, need special attention. If the extra day brings their pay below the minimum wage on an hourly basis, adjustments may be necessary to prevent underpayment. 📝 In summary, as we leap into 2024, remember to navigate the leap year nuances in employee pay with transparency and adherence to legal standards.     📢 Update from the States of Jersey Assembly! Yesterday afternoon, the States of Jersey Assembly voted to APPROVE proposed amendments to the Employment (Jersey) Law 2003 with an overwhelming 41 votes for, 0 against, and 0 abstentions. 🔑 Key Amendments: Employees with settled, consistent work patterns will be able to request changes to their contracts to reflect that pattern. - The settled pattern must be evidenced over a significant period (6 months) - Employees will be able to make one request for a change in a 12-month period - Refusals by employers will be tightly circumscribed - Employees will have the right to request a review of refusals and make claims to the Tribunal - Employers must provide new particulars of employment within 4 weeks of the amendment request; failure to do so may result in a fine of up to £10,000 🔄 Additional Change: Employees will have the right to make two Flexible Working requests within a 12-month period, up from the previous limit of one. The effective date of these amendments is yet to be confirmed. ❌ Notable Rejection: The proposal to set a maximum employment probation period of 6 months was REJECTED with 4 votes for, 35 against, and 0 abstentions. Proposed changes: - Maximum probation period of 6 months. - No probation for fixed-term contracts of 6 months or less. - Extension allowed only once. 🤔 What's Next: If you have any questions or need clarification on these amendments, we're here to help!
