When it has been established that unsecured loans are accommodation entries, mere repayment is not a ground to drop the addition U/S 68: Mumbai ITAT J. K. Global versus ITO Case Number: I.T.A. Nos. 3260, 3259 & 3258/Mum/2023 Facts: 1. The assessee had taken huge unsecured loans of 25 lacs from Ryan International, 5 lacs from Casper Enterprises and 20 lacs from Duke Business. These loans were also repaid during the year. 2. These unsecured loan were treated as unexplained and added u/s 68 of the Income Tax Act based on the information received from DGIT (Investigation), Mumbai that one Pravin Kumar Jain through a web of concerns run and operated by him is engaged in providing accommodation entries in the nature of bogus unsecured loans, bogus share application etc through various paper entities and the assessee is one of the beneficiaries who has taken accommodation entry. ITAT Mumbai held as below: 1. The contention of the counsel that the loans have been repaid during the year under consideration therefore the set off of the same should also be given to the assessee does not hold any water. 2. It has been established that the impugned loans were nothing but accommodation entries and the repayment is also nothing but return of accommodation entries. 3. Section 68 of Income Tax Act aims to ensure individuals and corporations transparently disclose their income by addressing unexplained cash credits in their books of accounts, placing the responsibility on the taxpayer to prove the legitimacy of such credits. 4. The money which has been brought in the garb of unsecured loan is nothing but the unaccounted money of the assessee, and deserves to be added u/s 68. TaxByte by CA Aniket Kulkarni

QUICK VIEW ON THE #BUDGET 2024 The Union Budget was overall not very eventful with the focus in most cases on long term schemes like that for employment generation, skill development, easing norms and pushing growth of MSME’s, easing compliance and focus as usual on rural areas. The good part of the budget has been the focus on fiscal consolidation with the Fiscal Deficit maintained at 4.9% and targeted at 4.5% next year. The importance of continued reduction in fiscal deficit is not widely understood but is actually very positive long term as the government borrows less and keeps more money available for the private sector i.e. there is no crowding out and this is also good to keep interest rates low and trend lower as inflation comes down. Capital Expenditure growth was maintained at around 17% which will mean that the second half of the year will see huge investment by the government after the lull of the election period. Contrary to expectations populism was missing from the budget speech. The cut in customs duty on mobile phones, gold and silver was also a positive move and could boost jewelry demand in the festival season.

Such entities do not need to exchange VM for NCCD transactions which are being done for the purpose of hedging. Key points with respect to Initial Margin : • Only financial entities with outstanding AANA of ₹60,000 crore and above shall be classified as Domestic covered entity –IM and Only financial entities with outstanding AANA of USD 8 billion and above shall be classified as Foreign covered entity –IM • Covered Entities may choose not to exchange IM for physically-settled foreign exchange forward and physically-settled foreign exchange swap contracts and fixed physically settled foreign exchange transactions associated with the exchange of principal of cross-currency swaps however all other payments or cash flows that occur during the life of the swap shall be subject to Initial Margin requirements • The initial margin shall be recalculated within a period not exceeding 10 working days.

Since the majority of cases are covered in these scenarios, it may not be prudent to increase the ambit of public shareholders’ approval at this stage,” said Binoy Parikh, Executive Director, Katalyst Advisors. According to Parikh, valuation parameters are relevant when there are related parties involved and not when there is a deal scenario between unrelated parties. In such cases, the parameters under the DCF method (like the veracity of the projections or discount rate) or use of comparable companies with similar size or business under the market approach, could be prescribed in further detail to make it more robust, he said. “If, in the ultimate analysis, it can be demonstrated that in no circumstance would the promoter holding go beyond 75 per cent, and any increase in shareholding is backed by a valuation report having contingency provisions, would ease and facilitate a lot of complex group restructurings,” Parikh said.
