HC grants urgent relief to 116 medical PG in-service candidates, directs fresh CAP round 1 to be conducted. The Bombay High Court (Aurangabad Bench) has directed the Maharashtra CET Cell to revise the merit list for in-service candidates in the 20% quota after adding incentive marks for service in rural, hilly, and Naxalite areas. This comes after two petitions (Ashish Patni v. State of Maharashtra and Mahesh Gurav v. State of Maharashtra) filed through Talekar and Associates highlighted the State's failure to implement its own policy regarding incentive marks. The issue arose due to the introduction of the percentile system and the difficulty in adding incentive marks to the percentile scores. The Court conducted a hand-holding exercise with the National Board of Examinations and relevant authorities. On December 6, 2024, a solution was finally found to add the incentive marks to the candidates' percentiles. The CET Cell is now instructed to publish the revised merit list, allow the 116 affected candidates to resubmit their preferences, and conduct fresh seat allocation for the 20% in-service candidate quota by December 15, 2024, to avoid delays in the second CAP round. Adv. Pradnya Talekar along with Adv. Umakant Awate and Adv. Vishakha Patil appeared in the matter for the petitioners. https://lnkd.in/gwGicMPS #talekarandassociates #highcourt #litigation #medicalpg #medicaleducation #studentsadmission #educationlaws #legalawareness #legalaid

The Hon'ble High Court directs resumption of flower offerings at Shirdi shrine with safeguards against exploitation and hygiene concerns: The Hon’ble High Court has directed the Shirdi Sansthan to resume the practice of allowing devotees to offer flowers and garlands at the Sai Baba Shrine, but with specific conditions aimed at preventing exploitation and maintaining hygiene. The Court’s decision follows an application filed by the Shirdi Sansthan, which sought the resumption of flower offerings, a practice that had been temporarily banned due to concerns over the extortion and harassment of devotees. Vendors around the shrine had been accused of charging exorbitant prices for flowers, often accompanied by misleading promises of VIP darshan. Adv. Pradnya Talekar and Adv. Ajinkya Kale on behalf of a concerned devotee informed the Court that a cartel of street vendors, mostly young individuals aged 18 to 30, had formed around the shrine. These vendors reportedly made significant profits from overcharging, which were then allegedly spent on alcohol and drugs. This behavior, it was argued, had contributed to a rise in criminal activities in the area surrounding the temple. In response, the Court has mandated that the Shirdi Sansthan make flowers available to devotees at reasonable rates within the temple premises. The Court also directed the temple authorities to take swift action to establish a sustainable and hygienic system for the disposal of floral waste generated by offerings.

Freedom of press is closely related to the financial autonomy of such media houses whereas the major source of revenue especially for the print-media is from the Government advertisements. Several small print-media houses found it difficult for sustaining themselves, in the absence of equitable distribution of Government advertisements. Although the State of Maharashtra had framed a policy for equitable distribution of the advertisements, most of the Government Departments and other autonomous public bodies were acting in breach of those guidelines. The Hon'ble High Court in a landmark judgment have directed the State and its instrumentalities to ensure that the policy of the Government in respect of distribution of advertisement is followed scrupulously. The Hon'ble High Court further directed the State Government to constitute a three member Committee who shall act as an ombudsman for redressal the complaints as well as monitor the Government advertisements which was directed by the Hon'ble Supreme Court way back in the year 2016. Senior Advocate Satish Talekar assisted by Adv Madhavi Ayyappan appeared for the petitioner Editor's Forum.
