How validity is dealt with in PI matters based on patents is currently a hot topic both nationally and in the UPC. The Finnish Market Court recently handed down three decisions in PI matters. In Finland, there is a presumption of validity of the patent, but this can be rebutted with sufficient grounds and evidence from the respondent. In two decisions, the respondents managed to rebut the presumption, and the court dismissed the PI application. In one matter, this was not the case, and the PI was granted. Yesterday our lawyer Hugo Snöbohm Hartzell, part of the AI team here at Synch, attended the SFIR seminar "Man or Machine" at SVA. The seminar covered topics such as the complex relationship between AI and intellectual property rights, the upcoming EU AI Act and its impact on copyright, and some practical use cases of AI technology. Lenovo v Ericsson judgment is out. Court was not prepared to make an order for a short term interim licence. As expected, distinguished over Panasonic v Xiaomi due to the present lack of the kind of undertakings both Panasonic and Xiaomi had made. The status quo remains and the Panasonic v Xiaomi interim licence reasoning so far seems to be a one off. I suspect SEP-holders going forward will do everything they can to avoid agreeing/undertaking to be bound by UK FRAND proceedings, even if there's an argument that refusing to submit to the UK courts might look like "unwilling licensor" behaviour. Respect to the Lenovo team for trying a normalisation argument where they say that the Panasonic case was "...a significant advance [that] involves the English court innovatively creating an interim remedy for a short-term FRAND licence to hold the ring pending the final FRAND trial..." The IP Court held a meeting on case No. SIP-334/2024 on the consideration of the claim of the R-Climate Company against Telefonaktiebolaget LM Ericsson (Sweden) on the early termination of legal protection of trademarks containing the designation "ERICSSON/ERICSSON" in the territory of Russia in respect of goods of the 11th class of the ICTU due to their non-use. In this case, Zuykov and partners represented the interests of the plaintiff, the R-Climate company. The R-Climate Company appealed to the copyright holder with a pre-trial proposal to conclude a contract for the alienation of exclusive rights to disputed trademarks in favor of the plaintiff or to apply for a voluntary waiver of the right to them. Having not received consent from the copyright holder, the plaintiff, after two months, filed a claim with the IP Court. In support of the stated requirements, the R-Climate company indicated that it was an interested party, and the defendant had not used its trademarks for goods of the 11th class of the MCTU ("devices for heating, cooling and ventilation") for three years. Based on the results of the case's consideration, the court decided to fully satisfy the R-Climate company's claims and prematurely terminate the legal protection of trademarks. #trademark #russia #ip #law https://lnkd.in/d69egSC2

Great IFCLA annual conference in Amsterdam. Not surprisingly, the implications of AI and related technologies for the law and modern society in general are also at the forefront here: together with my Finnish colleague Ismo Kallioniemi we examined, among other things, the securing of investments in AI solutions and the legal and factual protectability of the output of such AI tools. When it comes to IP and in particular copright, the question of how much concretization the prompting itself requires in order to adequately reflect the personality of the prompter and, thus, afford copyright protection, is intriguing. We are pleased to announce our partner, Julija Jerneva, one of Latvia’s influential attorneys specialising in competition law, has recently contributed towards the leading EU competition law enforcement practitioners’ text, providing an insightful report on competition law enforcement in Latvia to date. The contribution aligns with ongoing research as part of the Mapping Competition Law Review project, which undertakes an empirical study of all national judgments reviewing the application of Articles 101 and 102 TFEU and the national equivalent provisions between the entry into force of Regulation 1/2003 in May 2004 and April 2021. Logistics vs style/professional credibility? If the members of the EUIPO - European Union Intellectual Property Office's Boards of Appeal Sven Stürmann, Gordon Humphreys, Nina Korjus and Harri Salmi take the time and trouble to travel to Finland and Patentti- ja rekisterihallitus (PRH) - Finnish Patent and Registration Office organizes the seminar for local practitioners, the least I can do is to hop on my bike and ride to the other side of the city. We had very good afternoon session discussing on the recent activities and statistics of the BoA and got a deep dive in the recent decisions of the BoA and General Court. Deciding on confusing similarity of two trademarks (with or without reputation or weak elements) continues to be as difficult as ever (I wrote my masters thesis on this 20+ years ago...). But what struck me most was the fact that the Chinese applicants still clearly lead in the number of the EUTM and RCD filings, filling the registries with apparently non-used trademarks and designs. Is there something that could (or should) be done to that? Many thanks to the excellent speakers and active audience - it was great to catch up with so many of you! #safetyfirst
