The 2025 Global Competition Review (#GCR) directory highlights our firm in Spain and Portugal, in the Elite and Highly Recommended categories, respectively.   In Spain, the directory acknowledges Enrique Carrera’s team, indicating that it has a bustling merger control practice and highlighting its work representing clients in major transactions. Enrique Carrera heads up Cuatrecasas’ competition group in Spain, which includes fellow partner Irene Moreno-Tapia, as well as recently promoted counsel Maria Lopez Ridruejo and nine associates.   In Portugal, it acknowledges Pedro Marques Bom’s team for its work handling merger control procedures, behavioral issues and appeals against the competition authority’s fines. Nuestros expertos en Fondos Jorge Canta y Paz Irazusta participaron como ponentes en el III ‘Evento anual de fondos de capital privado’, que el pasado 10 de diciembre celebramos en nuestra oficina de Madrid. Desde un punto de vista regulatorio y fiscal, y tras un año de la aprobación de regulaciones que permitieron la flexibilización en la comercialización de productos alternativos, como la Ley Crea y Crece o la apertura del entorno europeo con el cierre de la normativa del #ELTIF, se abordaron las tendencias y diferentes alternativas de estructuración de vehículos. En su intervención, Jorge Canta destacó: «España se está quedando atrás en la creación de fondos 𝘦𝘷𝘦𝘳𝘨𝘳𝘦𝘦𝘯 o perpetuos, que ahora mismo es uno de los productos más demandados por el inversor de capital privado». Por su parte, Paz Irazusta señaló: «Para inversores españoles que quieran invertir en estrategias de 𝘦𝘲𝘶𝘪𝘵𝘺 el FCR/SCR o FCRE español siguen siendo las opciones idóneas; ahora bien, en estrategias de deuda y de real estate hay que ver cada proyecto». Last week, we presented the guide “Restructuring in Latin America: A year in review and legal perspectives and trends for 2025” at an event held at The Zo Clubhouse in New York City, where high-level speakers analyzed in depth the latest developments and future perspectives of #restructuring in #LatinAmerica.   Our lawyers Ignacio Buil Aldana, Mariana Campos Clasing, Alfonso Ugarte and Ignacio Inigo Lozano shared their experiences and perspectives on the changing legal landscape, along with Richard Cooper, a partner at Cleary Gottlieb Steen & Hamilton LLP, and Jorge Villen, Managing Director of Houlihan Lokey. We greatly appreciate Richard and Jorge’s participation.   In his speech, Ignacio Buil Aldana emphasized that the recent overhaul of the Spanish restructuring regime has significantly streamlined the process for handling complex restructurings in Spain. This success story, framed within the transposition of the Restructuring Directive in the EU countries, not only highlights the effectiveness of the reforms but also positions Spain as a potential blueprint for similar legislative changes across Latin America. By adopting these proven strategies, Latin American countries could enhance the efficiency of crossborder restructurings, fostering a more robust and interconnected economic landscape in the region.   Mariana Campos Clasing highlighted, "After the 2024 Constitutional Reform of the Judicial Branch, 2025 will be key for Mexico’s restructuring landscape. Concurso proceedings have become more effective as stakeholders gain expertise. Chapter 11 cases involving Mexican debtors have shown success, and Mexico could benefit from Spain and the EU's insolvency practices. Lower interest rates and greater macroeconomic stability in 2025 could boost refinancings and pre-packed proceedings.   Alfonso Ugarte stressed, "The crossborder component of our insolvency practice is increasing significantly every year as the market for distressed investing becomes more sophisticated. In this context, Latin American jurisdictions have the challenge of creating conditions of certainty and predictability that attract new money into distressed investments, helping companies renew their capital structure. We see legislative reforms as paramount to creating such conditions."   Finally, Ignacio Inigo Lozano noted that from our New York office, we have witnessed a surge of foreign proceedings, mainly Chapter 11, filed by Latin American companies to restructure their debt and access new financing. As part of the International Day of Persons with Disabilities that we celebrate every December 3, our Human Resources team organized a #GamifiedWorkshop together with the Prevent Foundation.   The session enabled all members of the firm to reflect on how to overcome fears and prejudices related to #disabilities in the work environment, thanks to the valuable contributions of Jesús Trabado Rodríguez, media planner at Movistar Plus+, and Carla Casals, speaker, coach and cofounder of Fundació Punt de Vista, and also a gameplay experience for the participants.
