🚨 Your Employer of Record (EOR) in Germany Might Not Be Compliant 🚨 Compliance should be your top priority when hiring in Germany. Did you know that working with an EOR that doesn’t hold the AUG (Arbeitsnehmerüberlassung) licence can lead to severe consequences? Daily, I speak with clients that are thinking about hiring in Germany, or already have an EOR team there. Time and time again, it surprises me that other EORs won’t inform them about the required AUG licence and 18-month limit on the employment term via this model. Or worse, they tell us that their team is indefinitely employed in Germany via so called ‘consultancy’ or ‘solution’ models. Unfortunately, these do not exist in Germany’s legal labour leasing framework, and the only compliant way to lease employees to foreign companies is via a licensed AUG entity. Here’s what you need to know: 🔍 Audits and Inspections: Non-compliant EOR providers can be audited at any time by German authorities. If they fail to meet the strict requirements, your business could face serious repercussions: 💸 Fines: Fines can reach up to €30,000 per employee for both the EOR provider and the end client. 🚫 Sudden Job and Salary Loss: The German authorities can immediately shut down a non-compliant EOR. Imagine the scenario where your employee is suddenly left without a job and salary. ⚖️ Legal Actions: The day-to-day employer (your company) could face legal action from the employee due to being hired in a non-compliant way. This could result in costly legal cases, fines, and high severance pay. 💡 The Solutions: 1️⃣ Always ensure your EOR provider holds the necessary AUG licence to legally employ workers in Germany on your behalf, and do not exceed the 18-month limit without a 3-month break in employment. 2️⃣ Thinking about employing for longer than 18 months? Layoffs just keep on coming 😰 In Germany, it's common for mass layoffs to happen on the 1st and 15th of the month because notice periods start counting down on those dates. To minimise payouts, companies often let people go right before. Here are some tips to protect yourself: 🧑‍⚖️ Get legal advice before signing anything. 📝 Get legal insurance, especially if you're not a native German speaker. 📸 Save your companies org charts and job postings for future reference. 📎 Download your company handbook. 📉 Save documents related to stock options. 💸 Ensure non-compete contracts are properly signed to get your compensation. 🈴 Keep evidence of your work and performance reviews. 🔐 Store files securely but avoid saving classified information. 🫵 Start talking to a recruiter to explore your options, and have a back up plan! Remember, not all layoffs are illegal, and many can be resolved amicably with the right evidence and communication. Having this information gives you confidence and leverage for your next steps. 💪

🤖 Your recruitment outbound sales automation will FAIL... ❌ If your tactics aren't proven to work at small volumes first. Or - at the very least - it will damage your brand. Especially if you work in niche, high-margin sectors. RecruitHub has clients generating amazing returns from automation platforms - saving countless hours and generating $tens of thousands in ROI. But the best results always come from: ☑️ targeting small, carefully-selected recipient groups ☑️ ensuring super high-quality, enriched prospect data ☑️ mapping out what high-quality sales engagement would look like WITHOUT automation - then replicating these steps with tech ☑️ gradually increasing volume as results are proven ⚠️ Rushing to 'scale up' sales efforts overnight through huge, muddy lists and end-to-end automation is a high-risk move IMO - yet to see it work, especially with so much channel saturation. Some patience now can lead to much bigger wins down the line.

Selling a job to a German candidate is different to a Brit or American. Hence why many firms struggle to hire in DACH. Some feedback: (based on 1,000+ interviews with German sellers) 1. Pitching start-ups jobs can be tough: → Start-ups in DACH often require lots of investment → It can be easier to sell an established company → Being a "one-person" team doesn't sell → Hiring a start-up "team" is key 2. German's are unlikely to believe "hype": → They see through the "over-selling of jobs" → What sells to US or UK candidates is often different → Just because the UK closed 5 deals doesn't mean Germany will What's actually important: - Data security - Realistic growth - Great colleagues - An amazing product - Strong salary packages - German customers / references - An understanding of the German market - A proper commitment to build a business in Germany 🔥 Focus on substance, not hype. 📈 The sales recruiting market has shifted Our key observation for Q1: Company requirements have changed drastically. Requirements have definitely become stricter. Some examples: ✔ +2 years relevant experience vs. talented career changer ✔ C1 vs. B1 English (for German profiles) ✔ Fixed hybrid split vs. remote ❌ Pay hasn't increased (significantly). Clearly, having lower headcount quotas to fill, companies are looking to hedge their hiring risks. At times, with vanity requirements that are supposed to make up for lacking clear role descriptions that often don't need these requirements. ✅ Good news to all companies looking for junior talent: less competition for motivated and talented career changers at the moment. What is your best onboarding element 🧳? I spent the last two days in Berlin, just being around the team and helping with small tasks. Some things are simply executed faster when you’re sitting together physically ⚡️ We’ve just onboarded a new colleague, so I also had some introductory meetings to provide a deep dive into Waitly. One of the topics was our brand and tone of voice 📣 People sign up to waiting lists because there is something at the other end they dream of or really wish to get. The waiting time is the uncertain and opaque step that they often highlight as the worst part of signing up. Signing up is the practical part; waiting for your dream apartment is about feelings. Feelings = emotions = many opinions = many questions. That’s one of the main reasons why Waitly is where we are today! We’ve managed to build a platform that takes care of the practical side and ensures full transparency and insights into each person’s individual waiting experience, leading to a better emotional experience. Every time I tell this story to a new employee (with a bit more context), they become even more committed to being part of Waitly and the journey we’re on. This has proven to be one of our most important onboarding sessions 🤝 We invest quite a bit of time in onboarding, but we’re probably not the best in the market. I see the following from conversations with founders & hr executives: - It is an advantage for companies with more junior employees to be present in the office - More self-organized and independent employees prefer the flexibility of a remote or remote friendly environment - Founders & Executives might think they solve organizational inefficiencies with getting more PERCEIVED control when employees are im office - I see more and more companies struggling with hiring people that have options, when not offering flexibility in the work setup Hard decision to make, you definitely can make it right for everyone.
