I now have 2 files opened with the OPO (Office of the Procurement Ombudsman) of Canada 1- General Dynamics management contract for the upgrade of the LAV awarded without a bidding process, in order to gain unrestricted, irrevocable and free of charge licensing rights to the best #digitalimaging technology in the World, owned by a Canadian MSB in Montreal, demonstrated in open bidding, beating NASA, and potentially the next Google, replacing Nortel in Canada's business picture. If we did not pull out then, our technology would now be ITARed as GD would have been able to give away the license to its US headquarter, restricting our market to whatever they decide, and preventing Canada to use domestic technology for its own defense sector. General Dynamics claimed the need to protect its IP. In 9 years and 533$million billed to Canada, the software still did not achieve certification as our demo was built in only 4 weeks... 2- Rule change to the SACC IP clauses. In this we use our Norton Rose Fulbright legal advice from Joan Clark, IP litigator, Supreme court wins, Order of Canada, and contend that the clauses are abusive, giving a too broad license to Canada to supply its needs. We recommend a) a license restricted to supplying Canada only, allowing exports from the Canadian sub with other potential partners b) a maintenance license to the major contractor, or possibly an integrator license for the purpose of delivering. Long term maintenance should be to the Canadian supplier who knows the technology and can therefore recommend upgrades in the future c) safe keeping of source code, implementation, drawings, IP, proofs, testing, supply chain... with an agreed third party between Canada and the Canadian supplier, a standard practice for professional engineer firms like ours #surveillance #military #nato #norad #canada #computervision
