    Undergraduate Political Studies thesis on secularism and religious neutrality in s.2(a) Charter jurisprudence. This paper makes the argument that Canadian courts view religion in Protestant-influenced terms, preserving religious liberty only where the adherent's religious practice is deemed "separable" from his or her everyday life, and ignoring the communal and lived aspects of certain religions. It examines several Supreme Court decisions such as R. v. N.S., Multani v. Commission scolaire…

This paper makes the argument that Canadian courts view religion in Protestant-influenced terms, preserving religious liberty only where the adherent's religious practice is deemed "separable" from his or her everyday life, and ignoring the communal and lived aspects of certain religions. It examines several Supreme Court decisions such as R. v. N.S., Multani v. Commission scolaire Marguerite-Bourgeoys, and Bal v. Ontario, and discusses the methodology used therein. Finally, it makes several recommendations as to how the courts can approach questions of religious freedom more holistically, taking into consideration the communal and lived aspects of religion instead of treating it as separable from everyday life.
