My Fellow Licensees, As President of the Canadian Paralegal Alliance, I am pleased to inform you that today we’ve advanced our case in Matter 24H-106 against Ngozi Akunna Oti, focusing on Allegation #3 ONLY: “Contrary to Rule 2.1-1 of the Rules, the respondent acted without integrity when she practiced law while her status with the Law Society was non-practicing.” Now, I’m delighted the Law Society recognizes this issue—particularly with Chair Leighton. However, what’s less delightful is the radio silence from the Law Society prosecutor. Despite my motion and repeated requests for a simple confirmation, they’ve responded with… nothing. Instead of addressing the facts, they launched an attack, accusing me of "collateral attacking" and “delaying the proceedings.” Let me be clear: that accusation is as valid as a lawyer misplacing their ethics guidebook. The Canadian Paralegal Alliance won’t tolerate double standards. Either the rules apply to everyone, or you drop the matter entirely. It’s really that simple. As for Chair Mercer, he has now graciously reserved his decision on whether we can formally intervene in this case. Stay tuned—because we know how much fun “waiting for the near future” can be with the Law Society. Meanwhile, the Canadian Paralegal Alliance has formed a special committee to closely monitor the Law Society and Tribunal. Facing immigration detention in Canada? Immigration detention is when individuals are held by Canadian authorities due to inadmissibility or public safety concerns. Reasons include: • Risk of not appearing for proceedings • Danger to the public • Unconfirmed identity The Detention Review Process 1. Initial Review: Held within 48 hours of detention to determine if continued detention is justified. 2. Subsequent Reviews: Conducted 7 days after the initial review and every 30 days thereafter. Tips for a Successful Detention Review 1. Hire an Immigration Lawyer o A skilled lawyer can advocate for your release, represent you in hearings, and protect your rights. 2. Gather Important Documents o Collect identity papers, character references, and proof of community ties to support your case. 3. Prepare Character Witnesses o Family members, employers, or community leaders can provide testimony to bolster your case. 4. Develop a Release Plan o Outline where you’ll live and how you’ll support yourself post-release to reassure the adjudicator. 5. 🇨🇦 ⚜ PAUSE ON LOW-WAGE LMIAS IN MONTREAL Starting September 3, Quebec will suspend the approval of Labour Market Impact Assessment (LMIA) applications for low-wage positions in the Montreal area. This freeze, lasting six months, applies to job offers with wages below $27.47 per hour. Exceptions will be made for sectors facing severe labour shortages, including construction, agriculture, food processing, education, and social services. Employers in the affected sectors should anticipate disruptions to workforce planning and begin exploring alternative recruitment strategies. Foreign workers who need to renew their work permits must urgently find other options to maintain their legal status. My fellow Paralegals and Lawyers, Today, I share with you my factum of the anti-SLAPP I filed against the Law Society and the Tribunal. I stand before you resolute that no one will take my rights away. This is still Canada, a nation where freedom of expression is a fundamental right. Witness how a bencher has blatantly abused their office; exposing the corruption within the Law Society's investigation. Observe how the current prosecutor, acting as an investigator, now manipulates the role of a prosecutor. The PAC allowed this prosecutor to submit a report that I haven't even seen. Not a single Paralegal bencher participated in the voting process. See the collusion between the former bencher and the former treasurer, using staff to execute their deceitful schemes. All this turmoil stems from the ambiguity of bylaw 4 regarding immigration matters. I am fighting for the public interest, striving to restore affordability and justice. Yet, the Law Society aims to bankrupt me with baseless proceedings. They refuse to let me summon their witnesses, rushing to conclude this charade. yet they are allowing to have pre hearing conference and every time I request one it gets denied. They want me to keep bringing motions so they can keep awarding the law society. How disgraceful it is that a tribunal member masquerades as staff in emails, and sympathizes with the prosecutor's incompetence, providing them with case law to use against me. The law society has not even raised matters yet the tribunal member is helping them. This is nothing short of a sham hearing. Paralegals, united, we are unstoppable. Those in the healthcare and social services space in Quebec should know about their new statutory obligations starting as of July 1, 2024 => Here is the scoop As of July 1, 2024, most of the obligations in the Act respecting health and social services information have come into effect (containing comprehensive #privacy obligations). ✅ Here are key highlights: 1️⃣ => Health and social services information (HSSI) is defined broadly (such as a person’s physical or mental health, medical history, biological material, health services or social services provided to a person, etc) 2️⃣ =>  You have specific governance requirements such as implementing safeguards, managing consent, performing privacy impact assessments, keeping logs of all accesses to HSSI, and more. 3️⃣ => Entities that provide services to HSS bodies must have written agreements in place with prescribed data protection terms The sanctions can also be pretty significant, ranging from $1,000 to $150,000, depending on who committed the offence and its nature. ✅ Bottom line: If you are in the #health and #socialservices space and subject to this Act, you should take the proper measures to comply with this Act.
