Last September, two litigation-focused Canadian legal technology companies, CiteRight and Jurisage Group, announced their merger, with the promise of combining CiteRight’s litigation drafting program with Jurisage’s AI technology to create an integrated legal research and drafting solution. Now, in the first application to result from that merger, CiteRight is today launching AI Insights by Jurisage, an AI-powered tool embedded within CiteRight that helps litigation teams quickly find, synthesize, and generate high-quality case law summaries. On May 15, the Québec government published the final version of its anonymization regulations, setting out the requirements that private sector organizations must meet to lawfully anonymize personal information. Kirsten Thompson and Sasha Coutu offer a summary of changes from the draft version, and what they mean for organizations. What is law the around the disclosure of records for speed measurement devices in BC? The rules of disclosure for these records would depend on which disclosure regime the Court deems to apply. These can be the law of disclosure under the Crown’s obligation to disclose, or the common law rules. In cases dealing with radar evidence, the leading case is from the BC Supreme Court in R v Khadikin, [1999] BCJ No 2575. In that case, the Court stated there must be: Evidence that the officer was a qualified radar operator; Evidence that he was operating a radar unit; and Evidence that the unit was tested and found to be working correctly. Case law in BC suggests that (maintenance, service, and calibration records are considered disclosure relevant to the accuracy of the speed measuring device. These items affect the Crown being able to establish evidence that the unit was tested and found to be working correctly. https://lnkd.in/gXVs6aPh

Canada privacy reform update - focus on Bill C-27 While initiatives to reform privacy laws in Canada have progressed significantly they remain, at the national level at least, an unfulfilled promise. The most significant reform now in place is found within Quebec’s revised private sector law, Law 25, now fully in force. On the other hand, the major overhaul of the current federal private sector law, PIPEDA, is stalled in Parliamentary Committee and is not likely to be in force, even if passed, before the next election. In my November Compliance Bulletin, I review the current status of the intended successor to PIPEDA, the proposed Consumer Privacy Protection Act. The CPPA is a key part of the government’s Bill C-27, the Digital Charter Implementation Act, 2022. My review addresses the amendments to date adopted by the Parliamentary INDU Committee.

📢 Canadian Intellectual Property Office / Office de la propriété intellectuelle du Canada launches IP Canada Report 2024; special section on IP finance. The IP Canada Report 2024 is the ninth annual report from the Canadian Intellectual Property Office (CIPO) summarising summary of intellectual property (IP) activity in Canada and abroad. It covers trends in patents, trademarks, industrial designs, and plant breeders’ rights, all of which CIPO says play a crucial role in IP research. CIPO is a special operating agency of Innovation, Science and Economic Development Canada (ISED), responsible for the administration of IP in Canada. Canada was ranked 15th in World Intellectual Property Organization – WIPO’s Global Innovation Index 2023; it has been in the top 20 ranked economies since 2010 🚀 CIPO says IP rights like patents, trademarks, and industrial designs are key in contributing to a country’s innovation and output. BC Commercial Litigation Lawyers! The BCCA released its decision in Wu v. Ma, 2024 BCCA 196: https://canlii.ca/t/k4tt0. I strongly recommend it as a "toolkit" case whenever you are seeking a mareva injunction. Voith J.'s reasons are an encyclopedia of the key leading cases (in my view), providing a great checklist for applications for mareva and preservation orders for counsel and the courts. Paragraphs 18-26 alone could save trees of paper (or many scrolls through a digital Book of Authorities) by obviating the need to cite the cases summarized in those paragraphs. Interestingly enough, I also recommend Voith's reasons involving the burden of proof and circumstances in which adverse inferences can be drawn by a party's failure to produce evidence that one would have expected would have been in their control and possession to be one of the better articulations of this principle I have seen in some time (paras 33-40). And, the facts make for quite an interesting read.
