The City-County of Butte-Silver Bow is seeking applicants who are interested in applying to be appointed to the elected position of County Attorney.
Commissioners will appoint a candidate to serve as the acting officer until the next general election Qualifications For County Office: 7-4-2201 General qualifications for county office.
A person is not eligible for a county office who at the time of election is not: (1) of the voting age required by the Montana constitution; (2) a citizen of the state; and (3) (a) an elector of the county in which the duties of the office are to be exercised; or (b) in the case of an office consolidated between two or more counties, an elector in one of the counties in which the duties of the office are to be exercised.
Butte-Silver Bow Code Section 5.
02 - Elections 1.
A candidate for any of the foregoing offices shall be a qualified elector and resident of the City-County for at least one (1) year prior to filing a nominating petition.
2.
In addition to the foregoing qualifications, a candidate shall have all education, training and experience required by state law, local ordinances and this Charter for the respective office.
3.
No person holding any of the above offices shall hold any other elective public office.
4.
Each elected officer must maintain residency within the City-County during the entire term.
7-4-2701 Qualifications for county attorney in certain counties.
(1) A person is not eligible for the position of full-time county attorney in counties that have a population in excess of 30,000 unless the person is a citizen of the United States and has resided in the state 2 years immediately before taking office and has been admitted to the practice of law for at least 5 years before the date of election or appointment.
Those seeking the interim appointment must submit an application by Friday, March 22, 2024, at 3:00 PM.
The appointed County Attorney will serve from April 1, 2024, through the time the elected County Attorney can be sworn in after the general election.
Additional screening tools and qualifications may be determined at the Commission’s discretion.
Interviews will be held on Wednesday, March 27, 2024.
Candidates may run for the election but are not required to do so.
