AI guardrails was a key topic of discussion at this week's G20 Summit in Rio, Brazil. With a focus on algorithmic bias, personal data security and digital inequality (e.g. digital exclusion, digital sovereignty, and the concentration of technological power), the Summit encouraged policies that guarantee data integrity whilst protecting human rights. One of the, perhaps controversial, proposals discussed (and supported by the National Human Rights Commission (CNDH)), was the guarantee of connectivity as a human right. Interestingly, Bill 2,338, which looks to establish guidelines for regulating AI, is currently under review in the Brazilian Congress. It seeks to ensure transparency, explainability, and accountability of the algorithms, preventing AI from reproducing prejudices through the expansion of society's control over the functioning of AI systems (especially in sensitive areas such as public safety, health, and education). #AI #artificialintelligence

Reminder for companies to consider global AI regulation when drafting #privacypolicies. Brazil's National Data Protection Authority (ANPD) suspended Meta's privacy policy in July over concerns about using personal data to train generative AI. Now, #Meta has agreed to inform Brazilian users about data use, starting September 8th, via email and notifications on Facebook and Instagram. For years, Brazilian companies would hire a single individual through a small company incorporated and wholly owned by such individual, in order to minimize employment costs and taxes. Such practice was viewed unfavorably by Labor Courts as a means of evading employer responsibilities and in many cases was deemed a fraud against the employment system. Brazilian legislation and Brazilian courts, however, have been shifting this perspective. Very recently, the Brazilian Federal Supreme Court (STF) analyzed a notable case of an individual who worked for six years as an employee before transitioning to an independent contractor role using his wholly owned enterprise with the same employer. Initially, the trial judge dismissed the employment relationship due to a lack of exclusivity and subordination. However, a higher court later recognized the labor relationship, viewing the change as fraudulent. STF ultimately overturned this decision, in alignment with court precedents affirming the right of economic agents to adopt business strategies that enhance economic efficiency, while taking into consideration the degree of vulnerability of the worker and its capacity for analyzing and agreeing with an alternative work structure. This ruling validates outsourcing and the use of companies wholly owned by certain workers, indicating a trend towards a more adaptable interpretation of labor laws to better reflect contemporary work dynamics and support economic growth. #BrazilianLaborLaw #outsourcing #Psflaw
