Cybersecurity across the European Union (NIS2 Directive) The NIS2 Directive is the EU-wide legislation on cybersecurity. It provides legal measures to boost the overall level of cybersecurity in the EU. The EU cybersecurity rules introduced in 2016 were updated by the NIS2 Directive that came into force in 2023. It modernised the existing legal framework to keep up with increased digitisation and an evolving cybersecurity threat landscape. By expanding the scope of the cybersecurity rules to new sectors and entities, it further improves the resilience and incident response capacities of public and private entities, competent authorities and the EU as a whole. The Directive on measures for a high common level of cybersecurity across the Union (the NIS2 Directive) provides legal measures to boost the overall level of cybersecurity in the EU by ensuring: Member States' preparedness, by requiring them to be appropriately equipped. For example, with a Computer Security Incident Response Team (CSIRT) and a competent national network and information systems (NIS) authority, cooperation among all the Member States, by setting up a Cooperation Group to support and facilitate strategic cooperation and the exchange of information among Member States.  a culture of security across sectors that are vital for our economy and society and that rely heavily on ICTs, such as energy, transport, water, banking, financial market infrastructures, healthcare and digital infrastructure. Businesses identified by the Member States as operators of essential services in the above sectors will have to take appropriate security measures and notify relevant national authorities of serious incidents. Reactive guardianship: Who intervenes? How? And why? Study offers interesting insights into complex decision-making processes   Criminologists Tim Barnum, Shaina Herman, Jean-Louis van Gelder, Denis Ribeaud, Manuel Eisner, and Daniel Nagin have recently conducted a study that offers interesting insights into complex decision-making processes by exploring bystander reactions and interventions in a bar setting. The study, which is part of the 360º Virtual Scenario Method research program, analyzed responses to a virtual scenario in which a young woman was being sexually harassed by a male patron.    Findings revealed that, while most participants agreed that the perpetrator's actions were inappropriate, nearly half chose to watch and wait rather than undertaking action, and only around 30% indicated a willingness to physically intervene. Preferred methods of intervention included seeking assistance or verbally stepping in.   The study shows that simply identifying a situation as problematic doesn't necessarily motivate intervention. 🤩A great meeting indeed! A privilege to work with all these professionals from 🇪🇺 Europe and 🇵🇪 South America.  We talked about subjects such as GenAI, the Data Act and the Data Governance Act (DGA). 👨‍🎓I informed the committee members about the DGA, based on an article co-produced with Patrick Wheeler : Main take-away: will the DGA be successful?  🚫The data re-use by public sector bodies in relation to sensitive data like IP-protected data and personal information are not mandatory.  🚫Data intermediaries: will they take off? So far, only 5 entities have been registered. Sure, the transition period is still active - so maybe this changes.  🚫Data altruism organizations. Who knows them? There's only 1 so far. Datalog from Spain. Perhaps the DGA has too little incentive for organizations to meet the requirements. The only 'reward' is an EU approved logo you can use. Or am I thinking too small-mindedly?

EU regulators have been a social media caricature for a while. Regulate first, ask questions later. But is that really such a bad approach? It's well-known that security agencies in the US have backdoors in pretty much every technological innovation of the last century. With the appointment of the Former Head of NSA as one of OpenAI's board members, it's clear that their intentions have not changed with AI either. EU absolutely is in its right to be careful here. In the short run, it may seem that the European AI act will favor incumbents by burdening startups with compliance costs & complexity. In the long run, given the unique structure of the AI market, the regulations will only drive more innovation in the Open Source AI sphere. Meta's llama models have been giving a tough battle to the proprietary competitors. Just as IBM funded Linux to counteract Microsoft, we can expect more bigger players to fund the open source market to counteract the impending monopoly structure. Freek Bomhof and Harrie Bastiaansen (and others), both consultants at TNO and affiliated with the CoE-DSC, recently published a whitepaper called ‘Leveraging the benefits of combining data spaces and privacy enhancing technologies’. Their conclusions about the advantages of combining data spaces and PETs are now being confirmed by the Agencia Española de Protección de Datos - AEPD and the European Union Agency for Cybersecurity (ENISA). They state that including GDPR principles in the design of data spaces is a clear requirement to reach the data sovereignty goals of data spaces. 🤖 We spoke to our AI specialist Philippe Coution about the ethical principles of AI, why we need them, the challenges associated with AI and how to maintain a balance of AI and regulation. 💡 As more and more AI systems are used in a wide range of products and industries, it is becoming increasingly clear how important the design and use of these systems are in terms of ethical criteria. Ethics cannot be applied to an AI system as an afterthought. It must be a fundamental requirement of an AI system, established before it is developed and then enforced throughout its lifetime.
