"While EFA’s original $1.25 billion loan did not come with any conditions around offtake, Friday’s additional loan was contingent on Iluka striking deals to sell the refinery’s product to customers deemed “satisfactory” to the government. The government is likely to prefer that Iluka’s customers were from “like-minded” nations such as South Korea, Japan, the United States and the United Kingdom, given the rationale for the taxpayer-funded investment was a desire to break China’s stranglehold on processing of rare earths like neodymium, praseodymium, terbium and dysprosium." The *correct* question to ask is this: "Do such customers from like-minded nations exist?" This is the question that should have been asked two years ago. "Oh, what a tangled web we weave when first we practice to deceive." This deception started in the USA with the pretense that there was a crisis in the supply of rare earths to US industry. There has never been a crisis. US demand for rare earths is de minimis and shrinking, not growing. This is how *politicians* both here in Oz and the USA screw an industry. They make up stupid phantom crises that do not exist and then go solve them by hamstringing an entire industry to direct effort to serve a non-existent customer. It is *your* #PoliticalClass hard at work *screwing* your nation.

100% agree with the author here - there are definitely potential valuer biases and conflicts which can arise in the process of striking unlisted valuations - and I have written extensively on these two topics in recent months. Governance over unlisted valuations must be effectively managed by super funds and investment managers in order to ensure unlisted valuations represent 'fair market value' and can withstand scrutiny and challenge from auditors, regulators and other key stakeholders. But most important of all, fund members must transact on 'fair' valuations to ensure they are not being shortchanged.... Shoot a DM anytime if you need a second opinion on a valuation report, or if you would like to discuss your firm's valuation governance model

MIGRATION: Hmmm - recent ABS data confirms that we welcomed 66,780 new entrants in July 2024 alone with a running total of 463,150. See that line all the way down in the chart (FY25 Govt Target) - for us to achieve that, we need to average only +17,500 per month going forward. Definitely not going to happen. A key theme of last night's Federal Budget was the unveiling of the Future Made in Australia program, with $23bn targeted at the energy transition sector (critical minerals and renewable hydrogen) to help achieve net zero. While this is certainly a welcome measure, the anticipated tax reform measures that we eagerly anticipate in the lead up to every Budget seem to have been taken outside of the budget process, to be progressed separately. There continues to be a focus on multinational tax integrity, with a number of previously announced tax measures being adjusted, deferred or discontinued. The expansion of the foreign resident capital gains tax regime, and the requirement to notify the ATO of certain transactions prior to execution, is significant and will impact (and likely, delay) a number of cross border transactions. 💡 A quick Friday refresher for the remaining ASX listed entities that are holding their annual general meetings by the end of November and reporting results of their AGM on the ASX Market Announcements Platform. 🗞 If an entity has received a first or second strike from its remuneration report at its AGM , you should take a look at ASX Listing Rule 3.13.2(f), a sometimes overlooked rule. Simply reporting the results of the meeting in a tabulated form from your registry is not enough, an entity must, in the announcement disclosing the results of the meeting indicate that it constitutes a first or second strike under section 250U of the Corporations Act. This rule also requires you to report the fact that a resolution was not put to the meeting and the reasons why. 📰 You should also consider the broader ASX Listing Rules 3.13.2 voting results requirements in relation to disclosing results on a show of hands or poll and report this in your results of meeting. 📣 An example of a "first strike" disclosure is ASX's own results of AGM on 28 October 2024: https://lnkd.in/g9aa3rV3
