Sydney siders (perhaps the rest of the country? perhaps cookie lovers’ full stop?), will have heard about the failed ‘Crumbl inspired’ pop-up store in Bondi recently, who happily charged customers around $17 for a single stale and somewhat underwhelming cookie. Delicious cookies originating from the US: https://crumblcookies.com/ The pop-up store did not have any affiliation, or authorisation from the US company – which raises a number of interesting legal questions, not least whether the Bondi pop-up infringed Crumbl’s Australian trade mark registrations. The pop-up organisers purchased genuine Crumbl cookies from Crumbl in the US and then imported and sold these cookies in Australia. On its face, the organisers have a defence to trade mark infringement if they can show that it was reasonable for them to conclude that the Crumbl trade marks applied to the goods they purchased, were applied by Crumbl (or with Crumbl’s consent). This is the parallel import defence, which legalises Australia’s current position on parallel importing – (very broadly speaking, it is permitted because it promotes competition and gives Australians access to a broader range of international products at a lower cost). Based on what we know, it seems likely that the organisers could rely on this defence – meaning that they were within their rights to import and sell the cookies in Australia. From a trade mark perspective anyway…the organisers could still face other legal claims from Crumbl, such as misleading or deceptive conduct under the Australian Consumer Law, copyright infringement allegations, breach of contract (with respect to Crumbl’s own product T&Cs) and potential breaches of the Australian New Zealand Food Standards Code. Thankfully for the organisers, Crumbl’s co-founder and CEO has jumped on the publicity train (or plane?), flying into Sydney last week to announce that the brand now plans to accelerate its plans Down Under. And why wouldn’t it? He expressed that Crumbl are not planning on taking any legal action against the pop-up organisers – and adopted an attitude similar to one that your mum might– it’s a compliment, not copying. All in all, it seems the pop-up organisers really did nab the good fortune cookie!

It’s exciting to launch a business but doing this is crucial if you want to keep the doors open 👇 I get it, starting a small business is both thrilling and overwhelming. These tools help me manage finances, optimise my time and ensure I’m building a sustainable business: 👉 Finances I track every expense and pricing adjustment in a spreadsheet I found on Etsy for $2. It’s a beginner-friendly way to monitor cash flow and keep your pricing strategy fluid and profitable. It's nothing fancy but for now, it doesn't have to be. It keeps my pipeline organised and customer data central. 👉 Time I track how long tasks take using Clockify (free version) to compare against my service prices. This helps my pricing strategy stay data-driven, adjusting as needed and identifying tasks I can outsource. 👉 Effort vs Return Initially, I estimated my hourly rate and the time required to complete each project, cross-referencing this with my Net Revenue to gauge if the profitability was worth the effort. Now, with data from Clockify and my pricing sheet, I can track profitability more precisely, ensuring that every project aligns with my revenue goals. 👉 Goals vs Actuals Each month, I set targets for revenue and leads and compare my results. This keeps me accountable, helps me learn from setbacks and ensures I’m on tracking towards growth. Success isn’t about having the fancy tools. It’s about consistency, tracking what matters and refining as you go. Implementing just a couple of these strategies can help build strong foundations for the future of your business. 🚨 Warning: Brand vs Performance marketing noise 🚨 Mr Ritson and MarketingWeek hits the nail on the head, again. Credit to ANZ brand (in NZ) and Astrud Burgess for leading the way. The brand ad had me tearing up. Just lovely 😍 Congrats on the award. So have people really been trying to do both long term brand building and short term sales in one advert? Most likely. I should stop being so naive. Then labelling it as some new amazing church we should worship. Welcome to the holy saint of “brand performance” or cathedral of “performance branding”. Apparently so. We do love a trendy new name on this platform. Eek. “When you have two masters,” Burgess observes, “and you try to build brand and achieve customer acquisition all within the same ad, you end up not doing either one particularly well.” (source: ANZ CMO, Astrud Burgess) Case in point: The recent Nike troubles. Truthfully the answer is never crystal clear. We seem over obsessed with data and attribution in today's modern marketing (ah, the promise of digital). It would seem ANZ have a sensible grown up approach to this whole nauseating debate. TOFU brand-building best with a new series of long-form, super-effective ads that she refers to as her ‘preference’ campaign. And on the other side investing in more basic, rational, targeted ads, united with the brand work through the ANZ brand codes, that pushed the different products that the bank offered for immediate sales. The ‘pathway’ work as she calls it. Call it TOFU or BOFU or to be honest, whatever you want. Just don't try to do it all in one ad or spend all your money in one camp. And you will be attracted to shiny new channels and technologies (yes, looking at you AI) but be focused on their use. And definitely measure it. But first be clear on what you are trying to achieve with your marketing dollars. Credit to ANZ and Mark R. Enjoyed this interview with Ashley Regan and our new CEO, Mat Baxter. I've noticed a pattern with agencies. At first, independent measurement can be challenging. But once leaned into it becomes a powerful driver of business growth and performance - for both them and their customers. Agencies who have worked with us over a period of time have increasingly become our advocates, including many who at the start were detractors. I don't think that's a co-incidence. On our side, I think we need to do a better job productising for agencies. We'll have more to announce on this soon, but the headlines I think are simple: - We need to make it easier across all parts of the supply chain to seamlessly supply data. DataOS has been a big help here, but we can do more to directly integrate. - We need to up our partnership program. We're exploring options here, including using the Salesforce model to drive this. I see huge value in training and working with agencies so they can build business models around us. - We need to integrate better with all agency systems so they can use our data within their own environments for their customers. All of this is to say - our customers care about their agencies being able to leverage their data, whilst they also love the fact that our data model is best in class and independent. As a customer-first company, we're going to lean into this heavily in the coming H2 as we look to build the best holistic measurement platform on the market.

Too often, businesses get caught up in chasing short-term performance gains and forget the long-term importance of brand building. 📈 This article reinforces that without a balance between brand and performance marketing, you risk undermining sustainable growth. It's not about choosing one over the other, but integrating both for lasting impact. Worth a read! 🤩

Don't ignore your account structures. While the buzz at the moment is about testing copy, testing creative and testing audiences, if you account isn't structured correctly you won't see the results you should. After learning the "secret sauce" structure in Melbourne six years ago, I have been able to deliver it for 1-Up clients right across New Zealand. We took over a new client's paid social in July and in two weeks we have: Reduced cost per ATC by 38% Reduced cost per Purchase by 48%. No changes to copy. No changes to creative. No new audiences. Lay the foundations first before you start getting too tricky with your adverts.

Little did I know I was coming down with something, and so all the warm, reassuring things I meant to say at the start of my talk about if I, as an arts and communications grad, a former maths-despiser, and UX-type, could get my head around commercial concepts, then so can you… Well, that part just fell out of my head. What’s left are some (I think) pretty useful tools and concepts for product people who want to try to lift their financial awareness. 🚀 9 Months of E-Commerce Excellence 🚀 Over the past 9 months, I've been running my own Shopify store, targeting the Australian market. This experience has allowed me to dive deep into all aspects of e-commerce, from launching effective social ad campaigns to optimizing store UX and SEO, managing email marketing through Klaviyo, and even handling customer service and product optimization. Love it or hate it, if you're an advertiser, you're being put on a diet. A cookie diet. 🍪 With Google Chrome to take the last cookie from the cookie jar soon by making them optional for consumers in Chrome, advertisers, marketers and PR pros are going to have to get creative, and instead of relying so heavily on individual tracking, actually deeply consider the context and behaviours in and by which their target audiences and customers operate. In the great landscape of commercial uncertainty, one aspect of change that's certainly prevalent here in Australia is dramatically changing regulation.
