Section 109R in Division 7A is an integrity measure targeting non-genuine loan repayments. Section 109R ensures that some payments made to a private company in relation to a loan will not be taken into account in working out: • how much of the loan has been repaid for the purposes of s 109D or 109E, or • the minimum yearly repayment for the loan under s 109E(5). The general purpose of s 109R is to prevent arrangements to avoid the application of Div 7A to loans that involve repaying them and re-lending the funds to the borrower. Section 109R does not apply to a range of payments that are specifically excepted. Excepted payments include those where the private company sets off certain amounts owing to the borrower against a loan, and payments to refinance the loan, including where the maximum term of the loan changes. We surveyed not for profit leaders across Australia on their organisation’s financial management to assess current financial management practices, challenges and opportunities. The results are detailed in the attached report, which includes best practices and insights for developing and reviewing the financial management of your organisation to ensure you are managing finances, risk and meeting the goals of your organisation. Report highlights Loss of major funding is the number one financial risk for 59% of respondents 68% reported their financial performance has been negatively affected by the current economic climate Rising operational costs are the biggest financial challenge for 85% of respondents Turnover within finance teams is at 60% which is affecting the teams output Budget constraints and limited resources are the primary barriers to technology investment. A good article on how the ATO is aggressively pursuing long outstanding tax and superannuation contributions in order to get tax payers back to paying their obligations in the ordinary course of business.
