Recent Australian Federal Court rulings emphasise the importance of conducting thorough due diligence trade mark searches before launching a new brand. Failing to check a trade mark's availability may compromise not only a trader’s ability to rely on honest concurrent use provisions in seeking trade mark registration, but good faith provisions as a defence to trade mark infringement.
