Scary to think that when I'm delivering a course on #psychosocial #safety, I have to watch my language very carefully to be sure that I'm not seen to be giving advice on workplace laws!! Discussing the 3 Codes of Practice which companies should be examining takes on a whole new meaning. When a lawyer tells you that it's very difficult to work out the meaning of #legal advice, it feels concerning. That's why it was great to hear from lawyer Elizabeth McLean (Libby), of Pragma Lawyers and Norfolk Workplace Consulting. Thanks to Monday HR for bringing this very robust discussion on all things workplace law last night at their HR Huddle. Loved the vibe in the room with so many amazing women but only a few men? Because our Fair Work Law is one of the most complex in Australia, there was a lot to talk about #risk and how #HR consultants can mitigate those risks. Working with small to medium companies means that the dollars and cents are always in the conversation so there is a reluctance to bring in a lawyer. The risks of giving legal advice however can be up to $50,000 and two years in jail and of course there's the reputational damage. So it's all about assessing the risk as an HR advisor and being sure to consult with other sources when defining things like the correct #award. Monica Moore and Eve Kavanagh, as experienced practitioners at Monday HR, feel comfortable preparing documents but they'll often have them signed off by a lawyer before finalising them with the client. What if your client doesn't want to pay a lawyer's fees? Where do you stand? Libby said that it's important to document the steps you’ve taken and to clearly document the advice you've given to your client to consult a lawyer. I loved Monica's take on things when she said that they have a 'No Cowboys' policy! So, look out for those 'red flags', mitigate the risks by consulting with a lawyer or other expert bodies and stay safe at work! (Look out of cowboys!) Great vibe at Besk Wine Bar in Leederville. Recently, a client faced a situation where they couldn't employ someone after giving a verbal offer, no paperwork had yet been issued or signed. Obviously, you want to avoid this, but we all know that sometimes unforeseen circumstances arise and things change. So, can you withdraw a verbal job offer? Yes! Q: Can we require our employees to wear a uniform? A: Yes! But it does involve legal and practical considerations 💡 Under the Fair Work Act 2009, employers can require employees to cover uniform costs if they are reasonable and without causing financial hardship or violating minimum wage standards. That said, factors such as industry, work type, and Modern Award coverage determine who pays.
