The High Court of Australia has confirmed that a permanent stay of proceedings in historical child abuse matters is limited to exceptional circumstances. This ‘extreme step’ is only to be taken following an evaluation of the nature, content and available evidence of each allegation and a determination that a trial of that allegation would be necessarily unfair in the circumstances.
