From January 2025 “wage theft” will occur when an employer intentionally engages in conduct which results in a failure to pay an employee an amount due to them. Inadvertent or unintentional underpayments are not captured by these new laws. Laws and penalties already exist for unintentional underpayments. A breach of the wage theft laws will attract heavy penalties: • for body corporates, $7.825 million or 3 x the underpayment amount; and • for individuals, 10 years in prison, $1.56 million or 3 x the underpayment amount. Last Tuesday, Lynch Meyer Lawyers Partner, Charles Moran, and Associate, Huan Do attended the National Fire Industry Association of Australia (NFIA) final SA Members' Meeting for 2024 and celebrated their State Awards of Excellence. Amongst all the headline industrial relations changes over the past 12 months is a lesser known, but equally significant, change which employers should be aware of. As from 1 July 2024 workplace delegates can represent eligible employees at various times including during disciplinary processes, which includes during disciplinary meetings. Prior to 1 July 2024 a workplace delegate was not able to do this in the absence of a specific provision in an enterprise agreement. These changes were introduced as part of the closing loopholes amendments to the Fair Work Act 2009 (Cth) (FW Act). Our Special Counsel, Kyle Lawson was invited by the Honourable Kyam Maher MLC, Attorney-General, and the Honourable Zoe Bettison MP, Minister for Multicultural Affairs in the South Australian Malinauskas Labor Government, to attend a Reception with the Asian Australian Lawyers Association Inc (SA Branch) at the Parliament House on 26 November 2024. The Asian Australian Lawyers Association Inc. (AALA) is the national peak body for Asian Australian lawyers and others with an interest in Asia. Since its establishment, AALA has become a leading voice for cultural diversity in the legal profession, working with peak bodies and organisations to promote intersectional diversity in the law. As a senior member of the legal profession, Kyle was privileged to meet other members of the legal profession of Asian background and had a meaningful dialogue on cultural diversity with the Attorney-General, the Minister, the inaugural Branch President Jessica Teoh, and the National President Matt Floro. Kyle looks forward to work collaboratively with AALA in 2025.
