Workplace Express article on the new NSW small claims jurisdiction - The NSW Industrial Court is now able to hear underpayments and small claims matters, with the goal of establishing a "substantial" small claims jurisdiction within six months, following a minor amendment to the Fair Work Regulations. The Albanese Government has issued the Fair Work Amendment (Minor and Technical Measures No. 2) Regulations 2024, which amends regulation 1.05 to clarify the NSW Industrial Court is an "eligible state or territory court" under s12 of the Fair Work Act. This will enable President Ingmar Taylor to get the Industrial Court's small claims jurisdiction up and running, as he foreshadowed in Newcastle in October (see Related Article), saying it would be modelled on the best aspects of the South Australian and Western Australian employment tribunals. This will provide practitioners with the opportunity to utilise a small claims jurisdiction with industrial expertise. The change also clarifies that the Industrial Court can hear most civil penalty proceedings, including underpayment claims "in a just, quick and cheap manner", a court spokesperson told Workplace Express.
