The UAE has emerged as an attractive destination for private wealth clients and advisors due to its favorable policies and initiatives. The country has overhauled its entry and residence system, offering new visa options and incentives to increase its appeal as a place to live, work, and invest. Estimates suggest the UAE will attract a net inflow of 4,000 millionaires this year, as hedge funds, property managers, and crypto firms relocate to Dubai, drawn by its excellent infrastructure, low taxes, and light regulation. Following the Cabinet and Ministerial Resolutions in October 2023 introducing a voluntary alternative scheme to statutory end-of-service gratuity, a committee formed of the Ministry of Human Resources and Emiratization and the Securities and Commodities Authority have now approved two investment companies to offer the voluntary alternative end-of-service benefits scheme. #5 of 7 Remedies available in local courts on enforcement orders and judgements of the DIFC Courts This paper comprehensively examines the remedies available in the UAE Courts on enforcement orders and judgments of the DIFC Courts. In particular, it discusses the judicial co-operation between the DIFC Courts and the Dubai Courts, and its ever-evolving nature and ease with which the conduit jurisdiction of the DIFC Courts can be used to execute judgments and orders before onshore courts in Dubai. Apart from delving into the procedure for enforcement and the pro-execution stance adopted by the Dubai Courts, this paper also deals with the mechanism for enforcement of judgments and order of the DIFC Courts in other Emirates. This paper is the fifth of a seven-part series on DIFC litigation and global enforcement & recovery, in the run up to the Dubai Arbitration Week 2024. 🚨 New GCC Fund Passporting Framework🚨 On 20 November 2024, the GCC financial market authorities approved a groundbreaking fund passporting framework. Investment funds will be the first financial products to be regulated under a unified framework at the GCC level. This new framework will be implemented early 2025 in the GCC states which have passed the requisite regulations. This initiative will simplify cross-border fund investment across GCC states, thereby increasing market integration. The UAE's ranking in the Basel Anti-Money Laundering Risk Index improved by 16 places from 2021 to 2023. This reflects the combined efforts of the government agencies and private sector to implement improved standards of compliance to combat money laundering, terrorist financing and proliferation financing. It is good to read in this article that these efforts are already paying off, not just in an improved ranking, but an increase in business and investment. #aml #uae #compliance

Markets Point Down - 16 Business and Private Equity Stories We Are Following Today. 1. The markets point down again today after a down day yesterday. 2. Between escalating tensions in the Middle East, lack of clarity re the election and the uncertain prospects for a soft landing we expect a good deal of volatility in the markets over the next few weeks. 3. Nike, a somewhat embattled company, is down nearly 6% premarket. 4. Private equity funds are finding it harder to find health care services platforms to invest in and relying further on trying to improve operations and add ancillaries. A challenge. 5. KKR is considering a takeover bid for the roughly $5 billion semiconductor and electronics equipment maker ASMPT Ltd. Bloomberg. Another sign the largest PE funds are very active. 6. Humana dropped nearly 12% yesterday. 7. Blackstone and Vista Equity Partners are teaming up to buy Smartsheet for nearly $8.4 billion. The big PE funds are getting active with a vengeance. 8. Oil is rising on Middle East tensions and back near $75 a barrel. 9. Coinbase and Bitcoin each fell significantly yesterday. Coinbase more than 7%. Bitcoin opens around $62000. 10. Apollo Global Management, Inc. jumped nearly 6% yesterday and is up nearly 42% year to date. 11. Tesla reports 3rd quarter deliveries today. It's been on track to sell around 1.8 million cars this year. It's stock is up over the last month but down for the year. 12. The federal deficit is a set to baloon to a record $35 trillion. The Congressional Budget Office has projected that it could make up 6% of US GDP by the end of this year, which would far outpace the 50-year average of 3.7%. Business Insider. Debt kills countries, companies and families. 13. Americans are quitting jobs at the lowest rates since 2000. 14. General Motors had a solid quarter and delivered 660000 cars, down 2% from a year ago. 15. NVIDIA dropped more than 3.5% yesterday. Don't bet against Jensen Huang, Elon Musk or Epic. 16. My colleagues in Doha wrote about the recently enacted Digital Assets Framework by the Qatar Financial Centre (QFC) Authority and the Qatar Financial Centre Regulatory Authority (QFCRA). Click below to see their write-up. Really great to see #Qatar pushing forward with regulatory clarity around #digitalassets. Of note, it regulates "investment tokens" -- tokens representing underlying rights to property that are defined as specified products, derivatives or rights derived from specified products under the QFC Financial Services Regulations. Multiple classes of share would be a great addition to the UAE Commeecial Companies Law as an option for ALL UAE companies and not just those seeking listing on the local stock markets, Dubai Financial Market and Abu Dhabi Securities Exchange.
