A recent judgment by the High Court of Kerala, 𝐕𝐢𝐧𝐞𝐞𝐭𝐡 𝐕. 𝐕. 𝐯𝐬 𝐊𝐞𝐫𝐚𝐥𝐚 𝐒𝐭𝐚𝐭𝐞 𝐄𝐥𝐞𝐜𝐭𝐫𝐢𝐜𝐢𝐭𝐲 𝐁𝐨𝐚𝐫𝐝 𝐋𝐭𝐝 𝐢𝐧 𝐖𝐏(𝐂) 𝐍𝐎. 9331 𝐎𝐅 2024, highlights the importance of adhering to procedural requirements in investigating complaints under the Sexual Harassment at Workplace (Prevention, Prohibition, and Redressal) Act, 2013 (the "POSH Act"). In this case, the Internal Committee (IC) of the Kerala State Electricity Board received a complaint under the POSH Act. Despite initiating proceedings, the Committee failed to serve the complaint and supporting documents to the petitioner, a mandatory step under Rule 7 of the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Rules, 2013 (the "POSH Rules"). Moreover, the witnesses of the Complainant were examined in his absence without allowing the petitioner to cross-examine them. The High Court held that the inquiry report issued was in violation of the rules of natural justice and quashed the report. The Court directed the Board to constitute a new Internal Committee to conduct the proceedings in strict compliance with the law, following the principles of natural justice and Rule 7 of the POSH Rules, and providing the petitioner an opportunity of hearing as well. While it may be tempting to take immediate action against an employee in the larger interests of the organisation, it is important to follow the requirements of law and allow both parties to present their cases. This approach ensures that no party has grounds to complain against the Internal Committee or the inquiry proceedings, thereby reducing the likelihood of an aggrieved party challenging the inquiry proceedings or the outcome before a public appellate authority. #POSH #KeralaHighCourt #JudgmentNote #WorkplaceHarrassment #BCPA #BCPAInsights

A public interest litigation has been filed before the Kerala High Court by advocate P. V. Jeevesh challenging the Union of India's decision to give Hindi titles to three new criminal laws - Bharatiya Nyaya Suraksha Sanhita, Bharatiya Nyaya Sanhita, and Bharatiya Sakshya Adhiniyam. The plea argues that this move violates Article 19(1) of the Constitution, which guarantees freedom of speech and expression to all citizens, regardless of language.
